ELD, HOS, and Drug Testing Applicability Notes

A cautious checklist for when ELD, HOS, and Part 382 drug and alcohol testing rules may or may not apply.

Quick checklist

  • Check ELD applicability before assuming a device is required or exempt.
  • Review 49 CFR 395.1 and ELD rule materials before relying on short-haul, driveaway-towaway, or other exception contexts.
  • For short-haul, verify the current 150 air-mile radius, return-to-reporting-location, and time-record conditions.
  • Check HOS exceptions separately from ELD exceptions.
  • Check whether 49 CFR Part 382 applies to CDL drivers operating covered CMVs, including the 26,001-pound CDL CMV threshold in 49 CFR 383.5 where relevant.
  • Document the exception or applicability reason in the audit packet.

Why this matters

The phrase where applicable is not enough for a carrier. If a rule does not apply, the file should explain why and point back to the official rule or FMCSA guidance. If it does apply, the carrier needs the correct records.

Common gaps

  • A carrier says short-haul but keeps no support records.
  • ELD exceptions are confused with HOS exceptions.
  • Part 382 is applied to every driver without checking covered-driver status, or ignored for CDL drivers who are covered.
  • The reason a rule is not applied lives only in the owner's memory.

Before / During / After audit

Before

  • Create a one-page applicability note for each exception used.
  • Link each note to official source records.
  • Review applicability when routes, vehicles, or drivers change.

During

  • Provide the note with the related records.
  • Avoid broad statements like we are exempt without the reason and source.

After

  • Update the note if operations change.
  • Train dispatch and drivers on the exception actually being used.
